1. Acceptance of Terms

By accessing or using Phona ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Phona is a voice-powered AI assistant platform that enables users to create, configure, and deploy conversational AI assistants. The Service provides voice interaction capabilities powered by Google's Gemini AI technology and allows users to integrate custom knowledge bases and business information.

3. User Accounts and Registration

To use the Service, you must create an account using Google authentication. You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring all information you provide is accurate and current

4. Subscription and Payment Terms

4.1 Free Trial

New users receive a 7-day free trial with limited daily usage (10 minutes per day). No credit card is required for the trial. The trial automatically expires after 7 days.

4.2 Pricing

We offer the following subscription plans:

  • Starter Plan: £19.99/month - 3 assistants, 300 minutes/month
  • Web Developer Plan: £49.99/month - 10 assistants, 1,000 minutes/month

Prices are subject to change with 30 days' notice. All prices are in British Pounds (GBP) and exclude applicable taxes.

4.3 Billing

Subscriptions are billed monthly in advance. Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access until the end of your current billing period
  • No refunds will be issued for partial months
  • Your assistants and data will be retained for 30 days after cancellation

5. Usage Limits and Restrictions

5.1 Voice Minutes

Each plan includes a monthly allocation of voice interaction minutes. Usage is calculated based on active conversation time. Unused minutes do not roll over to the next month.

5.2 Number of Assistants

The number of AI assistants you can create is limited by your subscription tier. Each assistant can be customized with its own knowledge base and configuration.

5.3 Acceptable Use

You agree not to:

  • Use the Service for illegal purposes or to violate any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to create assistants that impersonate others or spread misinformation
  • Scrape, spider, or crawl the Service
  • Share your account credentials with others

6. Intellectual Property

The Service and all related materials, including but not limited to software, designs, and documentation, are owned by Phona and protected by copyright and other intellectual property laws.

You retain all rights to the content you upload to the Service (knowledge bases, prompts, etc.). By using the Service, you grant us a license to use this content solely to provide the Service to you.

7. Data Collection and Privacy

Your use of the Service is subject to our Privacy Policy. We collect and process data as described in the Privacy Policy to provide and improve the Service. Please review the Privacy Policy to understand how we handle your information.

8. Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails or your account becomes delinquent
  • We believe your account poses a security risk
  • Required by law

Upon termination, your access to the Service will cease immediately. We may retain your data for 30 days to allow for account reinstatement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHONA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. AI-generated responses may contain errors or inaccuracies.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
